Q One of my most experienced nursery staff recently received serious injuries in a car accident and will be permanently disabled. I feel sorry for her, but surely I can't be expected to let her return to her job when she comes out of hospital?

A Under the Disability Discrimination Act 1995 you have a duty to make 'reasonable adjustments' to avoid dismissing a disabled employee. There is no upper limit to the level of compensation that can be awarded for failure to comply with this duty. You therefore need to be absolutely clear what it is that your employee will or will not be able to do.
