Toddler Death: Answers awaited at nursery

The parents of a two-year-old girl who died at an Essex nursery are raising questions about her death before an official inquest takes place.

Rhyia Malin was found by staff at Eton Manor Children's Day Nursery inChigwell trapped between the wall and roof of a wooden playhouse lastNovember. She later died of cardiac arrest in hospital.

At the time, nursery directors described the incident as 'a freakplayground accident' (News, 15 November). Essex police have finishedtheir investigation and are collecting evidence for an inquest, forwhich no date has yet been set.

Rhyia's father Jay Malin has told the Daily Telegraph that he constantlyquestions how his daughter died and why no member of staff was 'lookingout for her'.

The nursery received a good rating from Ofsted in its last inspectionreport, dated January 2006. However, the report also listed sevencomplaints lodged by parents from September 2004 to September 2005. Thecomplaints related to National Standards 2, 3, 4, 7, 11 and 14.

Six of the complaints concerned issues with supervision and ratios, andresulted in Ofsted issuing ten actions for improvement and onecompliance notice during this period.

An Ofsted spokesman said, 'Ofsted last inspected Eton Manor in 2006 andat this time there was no indication that it did not meet theregistration requirements.

'Following Rhyia's tragic death, we used our powers to insist thenursery made sure that children were no longer allowed near the Wendyhouse. Our investigation is still active. We are also working with thepolice and the local authority, who are responsible for safeguardingissues, and we cannot comment further until it is complete.'

A spokesman for Casterbridge Care and Education, which owns the nursery, said, 'We continue to co-operate fully with the police. We do not wishto pre-empt the outcome by commenting further.'
